Terms of service

Translation for information only. The German version is legally binding (clause 2.6).

Version: November 2026

1. Scope and provider

1.1 These General Terms and Conditions (T&C) apply to all orders placed in the CareYourMind online shop at www.careyourmind.ch.

1.2 The provider and contracting party is: CareYourMind, owner: Maximilian Haas, La Fayaula 64, 1583 Villarepos, Canton of Fribourg, Switzerland, email: support@careyourmind.ch

1.3 The version of these T&C valid at the time of ordering applies. By completing an order, the customer confirms that they have read and accepted these T&C.

1.4 The offer is aimed at private individuals residing in Switzerland. Deviating terms of the customer only apply if CareYourMind has expressly agreed to them in writing.

1.5 CareYourMind offers two types of products:

  • Printed products (e.g. journals and spiral notebooks), which are printed individually and shipped after ordering (print on demand).
  • Digital products (e.g. PDF workbooks, worksheets, guides and printable card templates), which are delivered by download.

2. Conclusion of contract

2.1 The presentation of products in the online shop is not a binding offer but an invitation to order.

2.2 The ordering process comprises the following steps: selecting products and adding them to the cart, entering contact details and, for printed products, the delivery address, choosing the payment method and reviewing the order summary. Before submitting, the customer can check and correct their entries at any time.

2.3 By clicking "Buy now" or "Complete order", the customer submits a binding offer to purchase.

2.4 CareYourMind confirms receipt of the order by email. For printed products, the contract is concluded upon shipping confirmation or delivery. For digital products, the contract is concluded upon completion of payment, and for free products upon completion of the order.

2.5 CareYourMind may decline orders without giving reasons, in particular in the event of obvious pricing or display errors. Any payments already made will be refunded immediately.

2.6 The contract language is German. Translations of these T&C are for information only.

3. Prices and payment

3.1 All prices are in Swiss francs (CHF). CareYourMind is not subject to VAT; no VAT is charged.

3.2 Shipping costs for printed products are shown in the order summary before the order is completed. No shipping costs apply to digital products.

3.3 Payment is made using the methods offered at checkout, currently credit card (Visa, Mastercard, American Express), TWINT, PayPal, Klarna, Apple Pay and Google Pay. Payments are processed by external payment providers; CareYourMind does not store any credit card data.

3.4 The purchase price is due upon completion of the order. Printed products are produced after successful payment; digital products are released after payment.

3.5 Discount codes and promotions cannot be combined unless stated otherwise and cannot be paid out in cash.

4. Delivery of printed products

4.1 Printed products are delivered exclusively to addresses in Switzerland.

4.2 Printed products are made individually for the customer after ordering and shipped by an external production partner. The expected production and shipping times are stated in the shipping policy. Delivery times are non-binding estimates unless a fixed delivery date has been expressly guaranteed.

4.3 Delays caused by carriers, customs clearance or other circumstances beyond CareYourMind's control will be communicated to the customer where possible. If the delay exceeds the stated delivery time by more than 30 days, the customer may withdraw from the contract; any payments already made will be refunded in full.

4.4 Benefit and risk pass to the customer upon handover of the goods.

4.5 The customer checks the parcel upon receipt and reports visible transport damage if possible within 5 days to support@careyourmind.ch, ideally with photos of the packaging and goods.

5. Delivery and use of digital products

5.1 Digital products are provided as PDF files for download. The customer receives the download link after completing the order on the order confirmation page and by email to the address provided.

5.2 To open and print the files, the customer needs a device with a standard PDF reader and, if applicable, a printer. Unless stated otherwise, the content of digital products is written in German.

5.3 The customer receives a simple, non-transferable right to use the digital products for personal, non-commercial purposes and to print them as often as they like.

5.4 In particular, the following are not permitted: passing on, reselling, lending or making the files publicly available (e.g. on the internet, social networks or cloud folders), editing and distributing them under one's own name, and using them in courses, groups, training sessions or professional practice without the written consent of CareYourMind. A corresponding licence for use with clients or groups can be requested from CareYourMind.

5.5 All rights to texts, graphics and design remain with CareYourMind.

6. Returns and withdrawal

6.1 Swiss law does not provide a statutory right of withdrawal for online purchases.

6.2 Digital products are excluded from exchange and return once the download link has been provided, as files cannot be returned. By completing the order, the customer acknowledges this.

6.3 Printed products are made individually for the customer and are therefore excluded from exchange and return.

6.4 The customer's rights in the event of defective or incorrectly delivered goods under clause 7 remain unaffected.

7. Warranty

7.1 The statutory warranty provisions of the Swiss Code of Obligations (Art. 197 et seq. CO) apply. The warranty period is two years from delivery.

7.2 The customer reports any defects promptly, at the latest within 14 days of discovery, to support@careyourmind.ch. The report must include the order number, a short description and, for printed products, photos of the defect.

7.3 In the event of a justified defect in a printed product, the customer may choose between a free replacement, a price reduction or a refund of the purchase price. A return is only necessary if CareYourMind expressly requests it; in that case CareYourMind bears the costs.

7.4 If a digital file is faulty or cannot be opened, CareYourMind will provide an error-free file. If this is not possible, the purchase price will be refunded.

7.5 Not considered defects are minor production-related deviations in colour, print or paper, in particular for print-on-demand products and due to different screen displays, as well as deviations when printing digital products that are caused by the customer's printer or paper. Damage caused by improper handling or normal wear and tear is also excluded.

8. Liability and note on content

8.1 CareYourMind products (e.g. journals, workbooks, worksheets and card sets) are intended for information, self-help and supporting well-being in everyday life. They are not medical devices and do not replace medical, psychotherapeutic or psychiatric assessment or treatment. No promises of healing are made.

8.2 If you have health problems or are in an acute mental health crisis, please contact your doctor, Die Dargebotene Hand / La Main Tendue (phone 143) or, in an emergency, call 144.

8.3 CareYourMind is only liable for damage caused intentionally or through gross negligence. Liability for slight negligence and for indirect damage, consequential damage and loss of profit is excluded to the extent permitted by law.

8.4 Mandatory statutory provisions remain reserved, in particular liability under the Product Liability Act (PrHG) and for personal injury.

9. Data protection

9.1 CareYourMind processes personal data in accordance with the Swiss Federal Act on Data Protection (FADP). Details can be found in the privacy policy on the website.

10. Changes to the T&C

10.1 CareYourMind may amend these T&C at any time. The version published on the website at the time of ordering applies to each order.

11. Final provisions

11.1 Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention, CISG).

11.2 Consumers may bring proceedings at their place of residence or at the registered office of CareYourMind (Art. 32 CPC). Otherwise, the place of jurisdiction is the registered office of CareYourMind in the Canton of Fribourg.

11.3 Should any provision of these T&C be wholly or partly invalid, the validity of the remaining provisions shall not be affected.

11.4 If you have any questions about these T&C or an order, you can reach us at support@careyourmind.ch.
